10th Circuit Court Rules 2018 Farm Bill Does Not Preempt Wyoming Hemp THC Laws

The 10th Circuit Court decided.

The 2018 Farm Bill does not override Wyoming’s hemp THC laws.

Wyoming bans hemp with THC above 0.3%.

Federal law allows it.

Court says: states can set stricter rules.

Case started in 2021.

Two companies challenged the state ban.

They lost.

Judge wrote: “Farm Bill sets a floor, not a ceiling.”

Hemp stays legal federally.

But Wyoming keeps its limit.

No change for now.

Industry watches closely.
