Michigan Lawmakers Propose New Crimes for Illegal Cannabis Cultivation, Delivery, and Processing

Michigan lawmakers are considering two bills, HB 5105 and HB 5107, to introduce new criminal penalties for illegal cannabis cultivation, delivery, and processing, as well as to adjust concentrate possession limits for individuals.

HB 5105: New Criminal Penalties for Illegal Cultivation, Production, and Delivery This bill establishes escalating penalties based on the quantity of cannabis involved:

  • For manufacturing between 10 kilograms and 25 kilograms of cannabis, or between 50 and 100 plants, or between 1 kilogram and 25 kilograms of concentrate, offenders face a misdemeanor punishable by up to one year in prison, a fine of up to $20,000, or both.

  • For amounts between 25 kilograms and less than 125 kilograms, or 100 to 499 plants, or 2.5 to 12.5 kilograms of concentrate, the offense becomes a felony with penalties of up to two years in prison, a fine of up to $500,000, or both.

  • For quantities between 125 kilograms and less than 250 kilograms, or 500 to 999 plants, or 12.5 to 25 kilograms of concentrate, penalties increase to up to four years in prison, a fine of up to $2 million, or both.

  • For 250 kilograms or more, or 1,000 plants or more, or 25 kilograms or more of concentrate, the offense is a felony punishable by up to 10 years in prison, a fine of up to $10 million, or both.

HB 5107: Changes to Concentrate Possession Limits This bill does not alter the existing 12-plant home grow limit or the 10-ounce personal possession limit but introduces a new 200-gram limit for concentrate possession. Violations would be classified as a misdemeanor, with imprisonment required only if the violation involved violence or was “habitual, willful, and for a commercial purpose.”

Both bills have been referred to the House Committee on Regulatory Reform for further consideration.
