Scutari Introduces Bills to Arrest Legacy Consumers, Create Interstate Commerce of Cannabis

New Jersey Senate President Nick Scutari (D-22) introduced two cannabis-related bills in the current legislative session. S 3171 would reinstate penalties for knowingly buying marijuana from unlicensed sellers, making it a disorderly persons offense with up to six months in jail and a $1,000 fine. It also targets illegal sellers and networks with manufacturing/distribution charges, allowing State Police and the Attorney General to shut down unlicensed operations and seize products. The bill has limited sponsorship. S 3151 empowers the Governor to negotiate interstate cannabis commerce agreements with other states for licensed entities, provided transportation complies and avoids unauthorized states. Foreign licensees would need New Jersey approval. Such agreements depend on federal changes, like descheduling cannabis, reduced enforcement, or low-risk DOJ opinions. Agreements require legislative review. The proposals address legacy illegal markets while enabling regulated interstate trade, though federal prohibition remains a barrier. Some local operators favor the status quo to limit corporate competition. States like California and Oregon have similar pacts, but full commerce is hindered without federal reform.
