Three companies—Nuka Enterprises LLC, Sima Sciences LLC, and Nuka Properties LLC—produced and sold the 1906 cannabis product line in Colorado since 2016. Their product, "Midnight Drops," is a cannabis and plant-based sleep aid in pill form.
Health Concerns
In 2020, consumers reported health issues with "Midnight Drops." The Colorado Attorney General's Office noted potential liver injury linked to Corydalis, an herbal supplement in products made before March 1, 2022. Post-2022 products, containing Stephania extract with L-THP, also showed elevated liver enzymes, indicating possible acute liver injury.
State Response
In 2023, the Colorado Department of Revenue's Marijuana Enforcement Division and the Colorado Department of Public Health and Environment issued consumer warnings about these health risks. The companies agreed to halt production and remove "Midnight Drops" from the market but failed to comply.
Legal Action
The companies neglected to research the herbal extracts adequately or inform retailers about the issues. The Colorado Attorney General's Office filed a lawsuit, leading to a settlement last week. The 1906 companies must:
Pay a $400,000 fine.
Cease operations in Colorado.
Meet unspecified conditions to resume operations.
Future Penalties
Violating the settlement terms could result in fines up to $1 million.
