Denver may loosen reigns around cannabis, but still no smoking at 4/20 festival

Denver may make it easier for cannabis companies to do business in the city, but smoking marijuana still isn’t permitted at the upcoming 4/20 festival.

Denver’s Department of Excise and License hosted a virtual town hall for cannabis businesses last month. City staff talked about proposed changes to regulating marijuana businesses as well as guidelines for the 4/20 Festival at Civic Center Park.

Making it easier to do business

An ordinance being drafted by staff that would need approval from the City Council would:

Allow medical cannabis businesses that lie within 1,000 feet of a school to allow recreational sales as well.

Put an end to mandatory hearings for marijuana businesses. Staff said it can cost companies up to $10,000 to have the hearing. Staff said most hearings are unopposed. In instances where there is protest, hearings still could be allowed at the city’s discretion. Efforts will be made for registered neighborhood organizations and others to resolve any concerns they may have about a cannabis business early in the process.

Allow court-appointed receiverships for cannabis businesses to make important decisions that are needed to bring their clients into regulatory compliance.

The City Council must twice approve the proposed changes to become law. The Business, Arts, Workforce, Aviation Services and Climate Resiliency Committee must also approve the ordinance.

Sparking up year after year

During the virtual town hall, city staff also explained the rules surrounding the city’s upcoming 4/20 music festival at Civic Center Park. Smoking cannabis at the event is not allowed and never has been, excise and license investigator Robert Darrow stressed. Thousands of guests spark up year after year at the event. Few arrests are made.
