An Appeals Court judge ruled Wednesday that Treasurer Deborah Goldberg failed to prove her appeal against reinstating Shannon O’Brien as Cannabis Control Commission chair will succeed. Judge Gloria Tan denied Goldberg’s motion to block O’Brien’s return, allowing her to resume her role.
Background
Goldberg appointed O’Brien as chair in September 2022, suspended her in September 2023, and fired her in September 2024. A Superior Court ruling favored O’Brien, prompting Goldberg’s appeal.
Judge’s Decision
Tan stated, “The defendant has not shown a likelihood of success on appeal.” The motion to stay O’Brien’s return was denied.
Reactions
Joe Baerlein, O’Brien’s spokesman, criticized Goldberg’s spending, saying, “The Treasurer has spent over $1 million on private lawyers and state resources. It’s time to stop.”
Andrew Napolitano, Goldberg’s spokesman, said, “We are reviewing our options.”
Goldberg’s Argument
Goldberg claimed the Superior Court ruling was wrong. She argued O’Brien’s return would disrupt the Cannabis Control Commission’s work and create confusion over leadership authority.
O’Brien’s term as chair continues through August 31, 2027.
