Judge Dismisses Lawsuit Over Arizona Dispensary License Dispute

An Arizona judge dismissed a lawsuit filed by Mason Cave, owner of Arizona Wellness Center Springerville, against the Arizona Department of Health Services (ADHS) and other state officials.


Cave claimed the state improperly awarded a marijuana dispensary license to Sherri Dunn, LLC, outside legal deadlines, violating the state’s Gift Clause and prior court orders.


Maricopa County Superior Court Judge Joseph Kreamer ruled that Cave lacked standing to sue and rejected the claims, stating that professional licenses do not fall under the Gift Clause and settlements are routine in litigation.


Cave’s legal team may appeal.
