Missouri lawmaker proposes amendment to overhaul marijuana laws

Missouri State Rep. Matthew Overcast (R-Douglas County) introduced House Joint Resolution 106 to amend the state constitution, repealing current marijuana laws for a less restrictive framework. It removes possession limits, allows adults 21+ to possess, use, and grow unlimited marijuana/hemp, and bars state criminalization or control. Home cultivation permits up to 30 plants in secure areas. Medical access expands to ages 18+ with self-certification and longer ID options. Protections include no property seizures, no discrimination for off-duty use (though impairment bans), and expungement of nonviolent pre-2027 offenses. It builds on Amendment 3's recreational legalization but eliminates many regulations. The resolution needs legislative approval and voter referendum, potentially for November 2026. It has received second reading but no hearing yet.
