Ohio Judge Temporarily Blocks Governor’s Intoxicating Hemp Product Ban

A Franklin County Court of Common Pleas judge issued a two-week temporary restraining order (TRO) on October 14, 2025, blocking Ohio Governor Mike DeWine’s executive order to ban intoxicating hemp product sales.
The TRO, granted to plaintiffs Titan Logistics Group, Fumee Smoke & Vape, and Invicta Nutraceuticals, delays the ban pending a preliminary injunction hearing on October 28.
Judge Carl A. Aveni ruled that the executive order violates the Ohio Constitution’s separation of powers by overriding legislative authority on hemp regulation.
DeWine cited youth safety concerns, but the plaintiffs argued the ban threatens their businesses.
