Smart & Safe Florida Submits 377,839 Valid Signatures for 2026 Marijuana Legalization Ballot Effort

The initiative, which was approved for circulation in January, would legalize the possession, purchase, and use of marijuana for individuals 21 and older. It would allow existing Medical Marijuana Treatment Centers to serve the recreational market and would allow additional adult-use licenses to be issued. The measure would cap possession at two ounces per adult and prohibit public smoking and vaping.
The campaign has raised around $20 million to date, primarily from the cannabis company Trulieve, which has dozens of medical marijuana dispensaries throughout Florida.The newest batch of signatures by far passes the 25% requirement for the imitative to be issued an official “judicial and financial impact review”.
The measure builds on the language of Amendment 3, which earned 56% support from voters in 2024—falling short of the 60% needed for passage. If approved by voters in 2026, the new amendment would take effect six months after election day, making Florida the next in a growing list of states to legalize recreational marijuana.
