Overview


The Texas Alcoholic Beverage Commission (TABC) adopted emergency rules effective September 23, 2025, per Executive Order GA-56. The rules block consumable hemp product (CHP) sales to minors to protect public health.


Key Rules


  • Prohibition: TABC licensees cannot sell, serve, or deliver CHPs to anyone under 21.

  • Age Verification: Licensees must check valid, government-issued ID with photo and description.

  • Penalties: Violators face license cancellation without suspension or fine options.


Exceptions


No violation if a minor presents valid ID, the licensee verifies it, and reasonably believes the buyer is 21 or older.


Health Risks


  • CHPs contain cannabinoids, like delta-8 THC, harmful to developing brains.

  • Risks include psychosis, suicide attempts, and lower educational outcomes.


Justification


  • TABC regulates businesses affecting public welfare.

  • Minors accessing CHPs threatens health and safety.

  • Emergency rules address urgent risks, per Government Code §2001.034.


Implementation


  • Rules effective immediately but enforced from October 1, 2025.
