The U.S. Supreme Court is set to announce on December 15 whether it will hear Canna Provisions Inc. v. Garland, a case challenging federal marijuana prohibition amid widespread state legalization. Justices will discuss the petition during their December 12 conference, with the decision revealed in the Orders List. Filed by state-licensed marijuana businesses, the petition seeks to determine if the federal ban under the Controlled Substances Act can persist, given conflicts with state-regulated markets where marijuana is legal. Plaintiffs argue that the Schedule I classification undermines state economies and laws. If granted review, this would be the first Supreme Court evaluation of federal marijuana prohibition's constitutionality in the context of modern state programs, potentially reshaping national policy. A denial would maintain current federal law, though the case could be relisted. Supporters include the Cato Institute and Pacific Legal Foundation, who plan to file amicus briefs, along with the Americans for Prosperity Foundation, urging the Court to rule that federal prohibition cannot override state markets.
