Virginia Republican Lawmakers Explain Why They Voted To Legalize Marijuana Sales

Several Virginia Republican lawmakers—Del. Otto Wachsmann, Del. Wren Williams, and Del. Will Morefield—broke ranks to support House Bill 642, which would legalize commercial cannabis sales at licensed retailers. Wachsmann cited the need for a regulated market to prevent underage access, ensure product safety, and displace the black market. Williams emphasized addressing persistent illegal sales despite disliking certain bill provisions. Morefield deferred comment but noted constituent moral concerns drive much GOP opposition. The House and Senate passed differing versions (HB 642 and SB 542) last week, requiring reconciliation before reaching Gov. Abigail Spanberger (D), who favors legalization. Differences include start dates (November 1, 2026 vs. January 1, 2027), excise tax rates (6% vs. 12.875% plus others), regulatory agencies, revenue allocation for equity/education/health, no local opt-outs, delivery permissions, THC limits (10 mg/serving, 100 mg/package), conversion fees for medical operators, and labor agreements. Related measures advanced: automatic resentencing for pre-2021 convictions, "Ryan's Law" allowing terminal patients' medical cannabis in hospitals (passed 95-1), parental rights protections against custody loss for legal use, and workplace safeguards for off-duty consumers.
