Delaware Senate Votes to Override Governor’s Veto of Bill Limiting County Restrictions on Marijuana Businesses

The Delaware Senate voted to override Governor Matt Meyer’s August 28 veto of Senate Bill 75, limiting counties’ ability to restrict marijuana businesses post-recreational legalization. The bill previously passed the House (25-13) and Senate (13-8). It prevents counties from using zoning to block state-licensed operators, allowing compassion centers with conversion licenses to function as retail stores despite nonconforming uses. Compliant building permits cannot be denied; retailers get minimum operating hours; indoor cultivation is protected in agricultural/industrial zones. Local bans are restricted to stores within half a mile of another or 500 feet of sensitive sites (schools, parks, churches, etc.). Meyer vetoed it for stripping local authority, favoring partnerships and revenue sharing instead. The override sends SB 75 to the Assembly; if also overridden, it takes effect in 30 days, clarifying regulations to support the regulated adult-use market while balancing state and local roles.
