A Missouri House committee unanimously (11-0) advanced House Bill 2641, reclassifying intoxicating hemp-derived products (delta-8 THC, delta-10 THC, THC-O, HHC, etc.) as marijuana. If passed, sales would shift exclusively to licensed marijuana dispensaries, ending availability at gas stations, smoke shops, CBD stores, or online. Cultivation, manufacturing, testing, transport, and retail would fall under Article XIV rules governing medical/adult-use cannabis. Violations carry $5,000 fines per transaction and Class D felony charges, enforced primarily by the Attorney General with Highway Patrol support. The bill adds medical marijuana patient privacy protections: barring unauthorized sharing of registry data with federal government or third parties (except by subpoena/court order), with Class E felony penalties for breaches. Consumers could request dispensaries avoid retaining identifying records. Hemp regulations activate automatically upon federal law changes expected later this year, aligning oversight with state marijuana systems. The measure now heads to the full House for consideration.
