House GOP Blocks Trump’s Cannabis Rescheduling Power

Bill Advances


House Appropriations Committee passed the 2026 Commerce, Justice, Science (CJS) bill 34-28 on Sept 10.

It stops the Department of Justice (DOJ) from using funds to reschedule cannabis.


Cannabis Status


Cannabis remains Schedule I under the Controlled Substances Act (CSA).

Schedule I includes drugs like heroin and LSD, deemed high-risk with no medical use.

The bill reserves rescheduling power for Congress, not the DOJ.


Trump’s Position


On Aug. 11, President Trump said he’s reviewing cannabis rescheduling.

He expects a decision soon but noted mixed public views.

Trump can’t reschedule alone but can direct the Attorney General or DEA.


Bill Details


The CJS bill allocates $76.8 billion, with $37.3 billion for the DOJ.

It cuts spending by 2.8% from 2025 to “right-size” agencies.

It also probes Chinese-linked cannabis businesses for money laundering.


Medical Cannabis


The bill keeps a rule protecting state medical cannabis programs.

Exceptions allow DOJ to enforce laws near schools or colleges.

Idaho, Kansas, Nebraska, and American Samoa lose these protections.


Other Provisions


The bill funds efforts against fentanyl and supports law enforcement.

It aims to counter China and end diversity, equity, and inclusion programs.


Opposition


Democrats, led by Rep. Grace Meng, oppose the bill.

They argue it cuts jobs and weakens agencies like the FBI.

Meng says it harms small businesses and rural communities.


History


A similar cannabis rescheduling block was in the 2025 CJS bill.

It was removed before final passage.
