The Kansas House Committee on Health and Human Services introduced House Bill 2752, the Kansas Health Freedom Act, on February 6, 2026, at Rep. Fairchild’s (R) request, establishing a broad medical cannabis program. The bill creates the Kansas Medical Cannabis Agency under the Department of Health and Environment to oversee licensing for dispensaries, cultivators, manufacturers, and testing labs. Qualifying conditions include any illness limiting major life activities or risking harm if untreated; patients and caregivers receive ID cards. Protections prevent discrimination in medical care, transplants, or firearm rights based on use. Certifications come from physicians, PAs, or APRNs without professional penalties. A seed-to-sale tracking system monitors the supply chain, with strict rules on packaging, labeling, and advertising. Possession is capped at four ounces of dried cannabis monthly (expandable with dual certification). A 4% sales tax supports administration, research, public health, mental health, substance abuse prevention, and senior property tax relief. Cannabis is removed from the state’s controlled substances act, allowing expungement of prior convictions and record sealing. Kansas, lacking a medical program despite neighbors’ markets and federal rescheduling momentum, aims to address patient needs through this legislation.
