Republican Rep. Nancy Mace of South Carolina is circulating the "American Hemp Protection Act of 2025" to block a federal ban on hemp-derived THC products, signed into law by President Donald Trump as part of recent spending legislation. The ban, effective next year, prohibits ingestible hemp items with detectable THC, impacting 90-95% of the market, including many CBD products, and threatening farmers, businesses, and billions in economic activity. Mace criticizes it for overriding state regulations and limiting consumer access for millions using cannabinoids. Her proposal aims to halt the ban while preserving the 2018 Farm Bill's framework, advocating age restrictions to 21+, standardized labeling, and third-party testing to protect children without eliminating the industry. She warns a ban would foster black markets, similar to past drug wars. Despite Trump's prior support for states' rights and CBD endorsements, the provision passed unaddressed. Industry groups express alarm over the lack of post-2018 regulations but support reversal efforts. Bipartisan lawmakers are developing comprehensive reforms. Mace, a marijuana legalization advocate, views this as a step toward common-sense oversight ensuring quality and access while addressing concerns.
