Recreational marijuana amendment headed toward review by Florida Supreme Court

A proposed constitutional amendment to legalize recreational marijuana in Florida is advancing toward Florida Supreme Court review for the 2026 ballot. State elections officials forwarded the Smart & Safe Florida committee's initiative to the Attorney General on November 18, 2025, resolving a lawsuit accusing delays. The committee has collected over 675,000 valid signatures, needing 880,062 by February 1, 2026, and already met thresholds for court scrutiny. This follows Governor Ron DeSantis' opposition to a similar 2024 measure. A separate dispute involves over 200,000 invalidated petitions due to a state directive requiring full proposal text on forms, rather than a webpage link; a hearing is set for November 22. The committee argues compliance with law, while the state insists on direct text inclusion for uniformity. Backed by prior efforts, the amendment seeks voter approval amid ongoing legal battles over petition processes and ballot access requirements.
